Question Trademark issue????plz help

Hi all.I need ur valuable suggestions.I have domain name that is a trademark of a certain company. I approached that company to sell this domain to them.But they they are telling that i catnt sell that domain to them & i HAVE to give them free.so friendz tell me what to do? should i donate it to that company or sell to 3rd parties????

Your first mistake > registering a name that is already trademarked
second > approaching them for selling

My suggession would be to hand it over to them, just be sure that the trademark is indeed theirs, let me know ur name by pm and ill help u further if u need.

Actually you are not wrong in the advice that you are giving but the truth is because I have been through it, you can purchase a Trademark name, and it is true that if they want to go through the $$$ of taking it from you they can but they will usually offer you a meager amount of money to buy it from you rather than go to battle but.......

NEVER offer the domain to them for sale! That usually will blow it!! They will come to you if they want it!!

I would STRONGLY suggest NOT to put a site up on it though!!

Thanx guys..i ll take care of ur words.Actually it was my mistake to buy a nice looking domain without making investigation about it.I bought it from Ebay.I think that Seller was also under pressure as he sold it to me @ just 56$.Anyway i dont want to enter into Fire...so changed my mind...n ll give that domain to its original TM holder..Thnax guys for ur suggestion :)

Well you have already made a mistake buy offering the domain for sale. Since its already had trademarked before you registered the domain ,legally you don't have much chance. Better just let it cool down no need to donate them the domain. They might approach you latter. If someone else like to buy the domain sell it.

Lets say you own a very hot trademark domain name but you are from a country that does not enforce intellectual property rights. Will they still wage legal battle on me?

I will suggest you
1) Don't park it! it is illegal and can used against you.. so make it resolve to nowhere until you find what to do
2) if you develop it develop it to something very different than the trademark services/products
3) I see no reason to donate to them, let it be and if you decide in the future renewals just drop it
4) I think that offer this domain to them if trademark issue is obvious its a mistake.
5) I have also a trademark related domain that i registered. My parking company made it to resolve to nowhere and send an e-mail that this domain may have some trademark problems.

Here is a funny article of a guy which is the owner of adwords.de, docs.de, labs.de, and five other domain names. This German "IT guy" Sebastian Klein, wants to give his domains to Google... in exchange for a job!

Yes, they can still wage legal battle unless the domain extension is that of your country, but it its a .com or any other international domain extension, the legal proceedings can be initiated from international courts to get the domain off you

They will if they decide that domain is worth the trouble or if they are willing to spend money on it. Most countries has intellectual property rights laws only thing is that those company's don't bother about it coz the costs related to them.

Just fyi, a good site for legal discussion on web hosting related issues can be found on this web hosting newsletter I found: http://www.web-hosting-newsletter.com/

Clikc on "Lunar Legal" at the left. I guess this guy is a lawyer for the hosting company and posts monthly about these kinds of issues. Might be worth a look.

Anyway, lol never approach the site you've stollen the trademark to!! Geez. They'll approach you if they want it, like everyone else has said.

just leave the domain alone to them you're lucky if they give you something out of their pocket, the first mistake actually is registering it and then offering it to them, the motive is already there.
