Default Thinking ahead .com or .what?!


As I understand you make money with .com domain as well as .anythings

What I need to know is:
Can you brand it/ trademark it when it is not .com?

And lets say I registered .info domain or .org or .us for example.

And someone will registere or already has registered same domain name but with .com

Can they take my domain away from me?!
If they trademarked it already or will do so in the future?!

If the name is trademarked, they can. But if it is not trademarked, you can trademark it even if it is just a .info.

If you register for example: (this won't happen, just an example) .biz and you make it into a search engine, they could sue you because you are using their service which everyone knows they use.

If the .com is trademarked after you have registered a .info or whatever, then they really can't say much. Especially if that particular .info is not the same market that they are in. However, I would advise you to get the .com if you plan to make a long term website that you plan to brand it. Even if there are no legal hassles, you'll still lose traffic to people who will automatically assume .com (and/or the browser).

If it's only trademarked. It's best to do some research first, you may run into some legal problems later if you are not careful.

Trademarks are Domain names are 2 different things. You come up with a word and trademark it for your business. So none can use that word except for you. you can buy any domain .info or .com , it doesn't matter. If you have .info for your business and someone else try to use .com for the same business but you have the copyrights for the name then you can take legal action against that person.

Yes,I can.In fact,I am a dot info fans.I think .info is a good gtld for develop a website.And seems in european countries people aslo like dot info.

This is tricky thing about law. There are always loopholes. Different usage of a domain can cause difficulties in them acquiring your domain especially if the domain is really exact.

Who ever does the trademark can get hold of the other extension names provided the other party is benefiting from the trademark.

Let me explain. You develop a .info domain and have a trademark for it. Now if the .com owner is using the traffic which they get because of your trademark, then well you can sue them and get hold of the .com name.

So in a nutshell, it doesn't matter whether you develop .info, .net or .com. Whoever trademarks the name has the better hand.

The above info is my opinion.
